Plaintiff, a college student, filed a lawsuit in Federal Court claiming that a College Police Department Officer violated his civil rights under 42 U.S.C. § 1983, which included claims for Unlawful Seizure-False Arrest, Excessive Force, and a State of California claim under the Bane Act (California Civil Code § 52.1).

Plaintiff claimed that the Police Officer arrested him without probable cause and used excessive force on his person, by unreasonably deploying his Taser and shooting him with a taser dart, causing him severe injury.
